Terms of use

After when using the Site, the Customer may not even partially publish, reproduce, copy, download, upload, post, email, sell or otherwise distribute any material, including text, graphics, logos, products, in whole or in part—pictures, images, etc. All this information is available on this Site (hereinafter - on Data). By downloading any Data, the Customer declares and warrants that he or she has the full right to reproduce and distribute the Data and that the Data are not contrary to the rules of use.

The Customer agrees that Viaplasts Ltd is entitled to save and delete Data, if required by law.

An order(s) for goods (s) from Viaplasts Ltd, which has been placed by the Customer (hereinafter referred to as the Order), sent to SIA Viaplsts online, is considered a binding offer, confirmed by the Customer at the moment of placing the Order. All he/she needs is to tick the box, "I agree to the terms and conditions." The Customer must accurately and fill in the details of the Order. The Customer is fully responsible for all data provided by him in the Order".

After receiving an Order, Viaplasts Ltd confirms receiving the Order by sending an e-mail confirmation to the Customer. The confirmation letter will come to the Customer's e-mail address specified by the Customer. It will be deemed received at the moment when Viaplsts Ltd sends the acceptance letter to the Customer.

All prices are in euros (EUR) and include applicable statutory taxes. Viaplasts Ltd is entitled to change prices and products from time to time unilaterally. The indicated prices do not include the delivery price, which depends on the indicated place.

The customer pays for the payment immediately after placing the order. If Viaplasts  Ltd has not received the payment within seven days after sending the letter of acceptance, Viaplasts Ltd is entitled to withdraw the Customer's Order confirmation.

It is also possible to pay for the Orders by transferring money to the bank account of Viaplasts Ltd based on the data that the Customer provided when placing the Order, or in cash at the moment of delivery.

Time of payment receipt -  when the Customer has transferred the payment to the  Viaplasts Ltd bank account. In the latter case, the Customer receives a payment receipt.

Ownership and risk of product damage for all customers of the Customer is transferred to the Customer when Viaplasts Ltd transports the orders to the carrier. The ordered product would be delivered after Ltd Viaplasts has accepted the law, and the Customer has paid for the order if the customer didn't pay in cash at the moment of delivery.

Delivery will take place from the premises of Viaplasts (Riga, Latvia) to the delivery address or ATM specified by the Customer when placing the Order.

When the delivery to the Customer is impossible because the Customer or a designated person is not available at the delivery address, despite that the Customer knew the delivery time by sending a reasonable notice, he/she must cover the costs of unsuccessful delivery along with re-delivery if the Customer requested it.

The Order is considered delivered to the Client when the carrier has given it to the Client.

If the Customer has decided to pick up the Order at the Viaplasts Ltd office in Riga, the delivery terms and conditions do not apply, and delivery costs do not have to be covered.   

Viaplasts Ltd guarantees that processing of the Customer's data will be carried out confidentially, ensuring compliance with the conditions of personal data protection. The data necessary for performing this operation is accumulated and may be transferred to third parties involved in the process (e.g., carriers) to the extent required for performing the Customer's Order.

Viaplasts Ltd does not guarantee that the information provided on this Website, including, among other things, the accuracy of the list of products and prices, is complete or up to date. Viaplasts Ltd reserves the right to correct errors, inaccuracies, omissions, and to update the information on the Website at any time without prior notification of the Customer (including after the Customer has sent his/her Order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. Viaplasts Ltd reserves the right to limit the number of products for any reason (including after the Customer has placed his Order).

Ltd Viaplasts is not responsible for and does not guarantee that the Website or its content will meet the customer's requirements, or that the Website will work without interruptions, without errors. Ltd Viaplasts also does not guarantee the quality of any goods, reliability of any information, as well as other materials, which the Client purchased by using the Website, will correspond to the Client's requirements, and that any defect will be eliminated.

The Customer agrees that Viaplasts Ltd is not responsible for any damage incurred by the Customer by reading this or that information on the Website.

Viaplasts Ltd also focuses on the fact that when shopping online, the Customer needs to take into account specific computer settings. It is possible to change product parameters - color, dimensions, etc.

Warranty and user manual

According to requirements of the regulatory enactments, Viaplasts Ltd guarantees that a quality product will be delivered to the Customer and that the product is made of a material suitable for the product's intended use.

The warranty of Viaplasts Ltd does not cover damage caused by incorrect transportation, improper use, negligence of the Customer, as well as excessive exposure to chemicals, electricity, and weather conditions.

Viaplasts Ltd undertakes to eliminate defects in the Product under guarantee - if the defect has arisen through the manufacturer's fault - at the Customer's choice: to exchange the Product for the same product free of charge. To return a part of the money paid for the Product to the Customer or to eliminate the Productproduct's non-conformity with the description in the Contract free of charge, if Viaplasts Ltd is unable to repair the Product or remove the defect.

The buyer must inspect the goods as soon as they are received to detect possible defects and deficiencies in the products. If hidden errors are detected, the Customer is obliged to notify Viaplasts Ltd in writing immediately after finding the faults.

Viaplasts Ltd does not bear any responsibility for the consequences of the repair of the purchased goods performed by the Customer or a third party without the prior written consent of Viaplasts Ltd.

Government of the Republic of Latvia Regulation No. 207 "Distance Contract Regulation" states that the Customer can cancel the contract within 14 calendar days and return the purchased goods. To formalize the right of withdrawal, the Customer must fill in the particular questionnaire. All documents related to the transaction have to be submitted.

The Customer, using the right of refusal specified in Government Regulations No. 207, shall be liable for any reduction in the value of the goods if their use does not comply with the Principle of Integrity, including use for other purposes than determining the properties of the products or the principle of action.

By refusing the product, the Customer undertakes to cover the shipping costs in full.

Viaplasts Ltd has failed to fulfill its obligations or delay in accordance with these Terms and Conditions, if such failure or delay was caused by unforeseen and insurmountable circumstances, including, but not limited to, fires, floods, other natural disasters, strikes, popular uprisings or general public health threat, as well as changes in international agreements and other relevant regulations.

Viaplasts Ltd has failed to fulfill its obligations or delay following these Terms and Conditions, if unforeseen circumstances caused such failure or delay, including, but not limited to, fires, floods, other natural disasters, strikes, popular uprisings or general public health threat, as well as changes in international agreements and other relevant regulations.

Any changes in the rules shall take effect immediately after Viaplasts Ltd has announced it on the Website. If the Customer ordered the Product and put an electronic signature in the previous version of the Agreement, the terms and conditions of the new version of the Agreement shall not apply until the expiry of the prior version of the Agreement.

The Client undertakes to indemnify Ltd Viaplasts for any losses, expenses, penalties, or expenses, as well as costs for legal services, which can be provided by Viaplasts Ltd, if the Company has suffered damage or the Company has to pay for the violation of the Client.
